Gerd Winter in Seoul

On 29 November, the South Korean Justice Research and Training Center (JRTC) in Seoul organised a conference on two “paradigm shifts” for the legal order, i.e. artificial intelligence and climate change.

In the session on “The Climate Change Crisis and Judicial Response”, Professor Gerd Winter of the Research Centre for European Environmental Law (FEU) delivered the key note speech on “Fundamental Rights to Climate Protection”. The discussion was related to several actions for stricter climate protection brought before the Korean constitutional court. The JRTC was interested in details of similar European and US American lawsuits, in particular the climate protection decision of the German Federal Constitutional Court of March 2021. With a large number of judges of various courts participating, the conference was an example of the transnationalisation of case law, i.e. how courts observe and learn from each other.
